Advocate Satyam Singh practicing in the Hon’ble High Court of Delhi and The Supreme Court of India has represented in various public importance cases. Adv. Shyam S. requested Attorney General of India Shri. K.K.Venugopal’s to initiate Contempt of Court proceedings against Stand-up comedian Kunal Kamra for his tweets against the Supreme Court of India.
The letter states that on 11 of November, 2020, a divisional bench of the Supreme Court consisting Justice D.Y.Chandrachud and Justice Indira Banerjee had granted bail to journalist Mr. Arnab Goswami.
During the course of the proceedings and also subsequent to the verdict, Mr. Kunal Kamra a stand-up comedian through his twitter handle @kunalkamra88 published some tweets which were derogatory in nature and intended to scandalize the Hon’ble Court. The tweets are as follows:
a) The Supreme Court of this country 1s the most Supreme joke of this country..
b) The pace at which the Supreme Court operates in matters of "National Interests it's time we replace Mahatma Gandhi's photo with Harish Salve's photo..."
c) DY Chandrachud is a flight attendant serving champagne to first class passengers after they’re fast tracked through, while commoners don’t know if they'll ever be boarded or seated, let alone served. *Justice"
d) "All lawyers with a spine must stop the use of the prefix "Hon'ble'" while referring to the Supreme Court or its judges. Honour has left the building long back...
e) Mr. Kunal Kamra has even tried to outrage the integrity of the Supreme Court by morphing an image of Supreme Court building and giving it an Orange Shade and depicting a BJP flag hoisted in the foyer of the Supreme Court. All the above mentioned tweets have been retweeted by thousands of his followers and other Twitter users.
All the above tweets were derogatory and also harmed the integrity of the Hon’ble court. The objectionable tweets are a deliberate attempt to provoke the masses to revolt against the Apex Court of India.
The aforesaid contemnor amounts to Criminal Contempt.
Criminal contempt defined u/s 2(d) of Contempt of Courts Act 1971
"Criminal contempt includes any act or publication which scandalizes' the court, or prejudices any judicial proceeding, or (ii) interferes with the administration of justice in any other manner. 'Scandalizing the Court' broadly refers to statements or publications which have the effect of undermining public confidence in the judiciary."
Advocate Satyam Singh requested Attorney General to initiate proceedings under Section15(1)(b) of the Contempt of Courts Act,1971 read with Rule 3 of the Rules to regulate proceedings for the contempt of the Supreme Court,1975 and initiate criminal complaint against Mr. Kunal Kamra.
