Supreme Court Disposes of SLP Filed by Advocate Anurag Rawal, Grants Liberty to Approach High Court for Modification of Bar Election Conditions.

The Supreme Court today disposed of the Special Leave Petition (SLP) filed by Advocate Anurag Rawal, granting liberty to approach the High Court for modification of specific conditions imposed in its judgment dated March 19, 2024, regarding the forthcoming bar elections in Delhi. The SLP (Diary No. 42875/2024) was argued by Advocate-on-Record Rajat Sehgal.


The petition challenged two key conditions mandated by the High Court judgment. Firstly, the mandatory requirement for a proximity card to ensure voting rights, and secondly, the condition requiring advocates to have made at least 12 court appearances in the past year to be eligible to vote.


The bench comprising Hon’ble Mr. Justice B.R. Gavai, Hon’ble Mr. Justice K.V. Vishwanathan, and Hon’ble Mr. Justice P.K. Mishra heard the matter and observed that there are practical difficulties in implementing the conditions as set out in the impugned judgment. Consequently, the Supreme Court has requested the High Court to reexamine the issues raised.


With this ruling, the Bar Associations and concerned parties now have the liberty to approach the High Court to seek a modification of the conditions that are seen as creating obstacles for many voters in the bar elections.


This development is expected to bring temporary relief to those advocates and voters impacted by these stringent conditions, as they now have the opportunity to present their concerns before the High Court for reconsideration.
